About the Program

The Deferred Prosecution/Domestic Violence Intervention Program office is located on 4R in the Rock County Courthouse.  Take the elevator that is next to the Clerk of Courts office to 4R, come out off the elevator and walk straight ahead to the next set of stairs, go up those stairs and the office is on the right side of the hallway.  It is handicap accessible.

An interpreter is available to accommodate Spanish-speaking individuals participating in the Deferred Prosecution or Domestic Violence Intervention Programs

Deferred Prosecution is a program whereby a person facing criminal charges or charged with a crime is diverted from the criminal court process.  To be eligible to participate in deferred prosecution an offender has no prior record, must accept responsibility for their offense, and must be willing to participate.  In addition, participation is allowed only with the consent of the assistant district attorney.  A person facing criminal charges can be referred to the program by the district attorney after their initial court appearance.

Participants are required to acknowledge responsibility for the criminal conduct and to sign a contract.  The contract may require them to attend classes, pay restitution, engage in community service, alcohol and drug treatment, and obtain counseling as needed.  The contract is designed to require the participant to take appropriate measures to diminish the likelihood of further criminal behavior.

Successful completion of the program results in the dismissal of criminal charges against the person or an amendment to a county ordinance.  If the person violates the contract or becomes involved in further criminal behavior, their case is returned to court for prosecution.
