Mediation Guidelines Summary

Prior to the start of a mediation session, the mediator will review the MFCS Mediation Guidelines, which all participants must sign. The guidelines address state mandates and MFCS policies and procedures regarding:

  • The purpose of mediation
  • Behavior during mediation
  • Safety
  • Restraining Order/Domestic Abuse Injunction or No Contact Orders
  • CPS involvement
  • Issues not appropriate for mediation
  • Confidentiality and exceptions
  • Caucus
  • Termination of mediation by a participant
  • Declaration of impasse by the mediator
  • Information provided to the court
  • Drafting and review of Memorandum of Agreement (within 14 working days)
  • Changes to Memorandum (within 15 days after receiving it)
  • Communications with collateral professionals
  • Mediator communications with attorneys
  • Return policies/procedures
  • Other proceedings during mediation
  • Legal counsel
