Temporary Restraining Orders/Injunctions:

Temporary Restraining Order and Injunction forms can be obtained from the Circuit Court Website or packets containing all of the needed forms are available in the lobby of the Rock County Clerk of Circuit Court's office. 

A Temporary Restraining Order is an order that, if granted by the court, is in effect until the injunction hearing which shall be held within 14 days after the Temporary Restraining Order is issued, unless an extension is granted.

There are four types of Temporary Restraining Orders and Injunctions:

  1. Domestic Abuse
  2. Child Abuse
  3. Harassment
  4. Individual at Risk

Documents can be filed in person at Window 3 in the Clerk of Court's Office or by using the drop boxes located in the Courthouse lobby or second floor by Clerk of Court's office. Be sure to include a phone number where you can be reached after the judge reviews your request. All Temporary Restraining Order/Injunction requests should be filed with a detailed statement outlining the circumstances surrounding the request. The court may deny your request if not enough information is provided.

Small Claims/Evictions:

Small Claims and Eviction hearings are heard in-person on Wednesday mornings by the Circuit Court Commissioner. All cases requesting eviction will have the initial appearance date set no greater that 25 days from the date the Summons was issued.  All cases requesting money and replevin will have the initial appearance date set no greater than 30 days from the date the Summons was issued. 

If service can not be obtained, the return date may be adjourned. An Amended Summons and Complaint will need to be filed to reflect the new court date.  However, all cases must be served on the Defendant(s) within 90 days from the date of filing or they will be dismissed.

All contested evictions will be referred to the duty judge after the initial appearance. The contested eviction hearing will be held within 30 days of the initial appearance. The hearing date and time for any contested cases will be provided at the initial Wednesday hearing. The same court official will hear any contested damage hearing at a date to be scheduled by the court after the eviction hearing.
