 Subpoena

A Subpoena is a document by which a party to an action can cause a person to appear in court to give testimony or to require that person to bring specified documents to court. 

 To issue a Subpoena for a Rock County court proceeding:

  • Fully complete the GF-126A Subpoena 
  • Mail or drop off at the Rock County Clerk of Circuit Court's Office. If the Subpoena is mailed, you must include a self-addressed stamped envelope for the completed Subpoena to be returned to you. 
    • NOTE: Subpoenas do not get filed into the court record so they cannot be eFiled for signature. 
    • No fee is required. 
  • The Rock County Clerk of Circuit Court will sign and issue the Clerk's Seal on the top of the Subpoena.
  • If the Subpoena was dropped off in person, the requestor will be called to pick up the Subpoena. If the Subpoena was mailed with a self-addressed stamped envelope, the Subpoena will be mailed back to the requestor. 
  • The requestor is responsible for arranging for proper service of the Subpoena. 
  • Once service is made, the Subpoena does not need to be filed in the court file unless the county is required to pay the witness fees. 

Foreign Subpoena:

A Foreign Subpoena is a document by which a party to an out-of-state action can cause a party or entity who does not reside in the foreign jurisdiction to appear in court in that foreign jurisdiction to give testimony or to require that person to bring specified documents to court or other proceeding. 

To issue a Foreign Subpoena for a Rock County resident or entity:

  • Fully complete the GF-127A Foreign Subpoena along with a copy of the Subpoena issued by the foreign jurisdiction. 
  • Mail or drop off at the Rock County Clerk of Circuit Court's Office. If the Foreign Subpoena is mailed, you must include a self-addressed stamped envelope for the completed Foreign Subpoena to be returned to you.
  • No filing fee is required to issue a Foreign Subpoena.
  • The Rock County Clerk of Circuit Court will sign and issue the Clerk's Seal on the top of the Foreign Subpoena.
  • If the Foreign Subpoena was dropped off in person, the requestor will be called to pick up the Foreign Subpoena. If the Foreign Subpoena was mailed with a self-addressed stamped envelope, the Foreign Subpoena will be mailed back to the requestor.
